Private and family life - extradition

Private and family life

AC appealed against her extradition order to Sweden to face two criminal charges, namely abducting two children children and retaining them abroad.

The appellant alledged that the decision to extradite her was in breach of Art 8 of the European Convention of Human Rights, in that it was disproportionate interference with her right to private and family life. Her appeal failed on this ground.

However, the extradition order has been quashed, as a new evidence was laid before the judge, which if was available to the judge below, would have made material difference.
