Review of refused settlement applications by Tier 1 migrants

The Home Office has published a review which investigated concerns as to whether there were systemic issues leading to settlement applications by tier 1 migrants being incorrectly refused. The review found that 83% of the refusals made under paragraph 322(5) of the Immigration Rules showed tax errors where amendments were made more than three years after the date of the original tax return.

The UK Visas and Immigration has published instructions containing guidance and information for caseworkers considering applications by tier 1 migrants where there are discrepancies in their self-employed earnings records.
